This Contract takes affect for any puppy purchased after Jan. 1, 2008
*Puppies will not be not be held without a deposit. The deposit is $100 dollars. I will keep the puppy till it is time to go to its new home at 7 weeks or 8 weeks for flying. Deposits are nonrefundable. The deposit may be put to another litter if you wish. But if you move your deposit to the next litter the puppies may be a higher priced litter and you will have to pay the difference or wait for another litter. *There will be a $10 dollar penalty for every day the puppy is left past the arranged pick up date (given a three day grace period). *The Seller guarantees this puppy/dog to be in good health at time of sale. *Within 72 hours from the time of this agreement, the Buyer must have has/hers puppy/dog checked by a Licensed Veterinarian at HIS/HER expense. If buyer fails to have the dog checked within the allotted time the puppy will not be replaced. I must have some form of proof sent to me of the first vet visit within 7 days to put in my records. Records can be mailed or emailed to buyer or your guarantee will be Voided! (Seller must be notified immediately) Should the puppy/dog have a congenital defect, the puppy/dog will be replaced with one of equal or less value, upon the return of the puppy/dog. (MINUS SHIPPING OR ANY OTHER EXPENSES IF APPLICABLE) Buyer is responsible for shipping fees or pick up. If the puppy/dog chosen is of greater value, Buyer will be responsible for price difference. Puppy/dog must be returned to Seller or Breeder within 7 days from the time of the vet visit unless a terminal genetic defect is detected and puppy/dog is unable to fly. A Licensed Veterinarian's written statement, with a complete diagnosis as well as signature, and copies of ALL medical records must accompany the return of the puppy/dog in order to obtain a refund. This provision is subject to confirmation by My, the Seller's Veterinarian. *Seller warrants against life threatening congenital defects for the first 11 months. Again, You must request a written statement from two licensed veterinarians and signed by him/her for our records (immediately notify Seller), stating health problem to include a description of the symptoms supporting his/or her opinion to validate guarantee. We are not responsible for vet fees, treatment costs, transportation costs, stress, or other expenses. This provision is also subject to confirmation by my, Seller's veterinarian. We will not warrant against Demadex Mange in puppies/dogs sold as pets or for breeding. *Australian Shepherd come with a 48 hour health guarantee on listed defects: blindness & deafness. If we know any of these defects we will tell the owner at the time of purchase and place puppies in a home that can help the puppy's condition. Australian Shepherds that are primarily white covering the ears and eyes have a higher risk of being blind or deaf. *Internal and external parasites (ie: roundworms, hookworms, whipworms, tapeworms, ringworms, ticks, fleas, giardia, coccidia, etc.) injury or neglect once the puppy/dog has left the Seller's or the Breeder's premises, allergies, exhaustion, stress related conditions, heat prostration, or any other conditions preventable by the Buyer will NOT, under any circumstances be warranted and will void this contract/health guarantee. *Seller does not warrant against Mange, Parvo Virus or Corona Virus once puppy/dog has left Seller's or Breeder's premises. *The Seller guarantees that this puppy/dog will be on parasite preventive and will have his/her vaccines up to date at time of purchase. However, we cannot guarantee that the puppy/dog will turn out negative on a fecal exam. Please understand, that de-wormers are given to help prevent, but in no way or form can we guarantee that they will be a success. It is the responsibility of the Buyer to contact their Veterinarian for a complete worm and vaccination program. *Do not vaccinate your puppy/dog within the 7 days of his/her arrival. A vaccination contains modified live viruses. *All spay/neuters: Puppy will not be spayed/neutered before puppy is 11 months old. Any puppy put under anesthesia before 11 months old is done at your own risk and puppy will not be replaced if death occurs. *If sold on co-ownership, buyer must receive first & 3rd pick of the dog’s first litter before owner can receive full registration. *If puppy is replaced for any reason any cosmetic treatment you have done, such as de-clawing etc. will not be repaid. *Pets or Breeding puppies, Seller cannot guarantee the puppies mature size, color, temperament, or breeding quality. We are selling the puppy with no guarantees that your puppy will be breeding quality; we are only selling you the right to breed one of our puppies when we sale them as breeding puppies. When sold as a pet only, buyer will get full registry when we get a vet record saying the puppy is spay/neuter. Shipping Only People: *Shipping is optional and the sole responsibility of the Buyer. We will ship puppies through Continental Airlines & American Airlines. If we have to send a puppy through another airline we will. We invite and encourage Buyers to personally pick up their new addition. Flying costs will vary. The breeder will not warrant against puppies that acquire stress related sicknesses or skin conditions. Please understand flying is very stressful, but we will do all we can to make it as easy on the puppy as possible. *All guarantees take effect at time and date of purchase for puppy/dog that will be picked up. All guarantees take effect at time and date of puppy/dog being shipped on our time schedule. For puppy/dog that will be shipped the agreement begins once the puppies leave the breeder. *At NO time will shipping costs be refunded. If you purchase one of our puppies and you live out of state, two copies of this contract will be mailed to you, one will be signed by me and that is for your records, you will sign the other one and send it back to me for my records. *If for some reason you cannot take care of this puppy you can contact me so I can help you by taking the puppy back or finding a home for the puppy.
